In the course of a User / Subscriber using the Melvano Mobile Application (“App”) or availing the Services and Facilities hereunder, Melvano Education Private Limited (“Company”) may become privy to the personal information of the User / Subscribers, including information that is of a confidential nature.
This Policy (“Privacy Policy”) is an integral part of the Terms of Use as mentioned on the App. This Privacy Policy is incorporated into the Terms of Use by reference. The words “You” “Your” “User” and “Subscriber” in this Privacy Policy will have the same contextual meaning unless defined otherwise.
This Privacy Policy along with Terms of Use describes our practices regarding, including your choices in relation to how we collect, store, use, share and secure your personal information across our Platforms. It also describes your choices regarding use, access and correction of your personal information and your rights in relation to your personal information and how to contact us or supervisory authorities in the event you have a complaint.
By visiting our App, you agree to be bound by the terms and conditions of this Privacy Policy. Please read this Privacy Policy carefully. By using the Platforms, you indicate that you understand, agree and consent to this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not use/access the Platforms.

By mere use of the App, you expressly consent to our use and disclosure of your personal and non-personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the Terms of Use.
We have taken all reasonable measures to protect the confidentiality of the personal information and its transmission through the internet and it shall not be held liable for disclosure of the confidential information when in accordance with this Privacy Policy or in terms of the agreements, if any, with the user / subscribers. To preserve the confidentiality of all information you provide to us, Melvano maintains the privacy principles mentioned hereinafter:
Melvano has policies and procedures concerning the collection, storage use and security of your information that will help protect your privacy. This Policy endeavours to help us serve you while maintaining strict privacy and security standards.
1. PERSONAL INFORMATION
The Company collects several types of information which is primarily used to serve you better and maintain authenticity of Services by identifying you. The Company does not collect data pertaining to the User/Subscriber from any third parties. Details of such information (collectively called “Information”) are as follows:
1.1. Personal Information
Personal Information is Information collected that can be used to uniquely identify or contact you. Personal Information for the purposes of this Privacy Policy shall include, but not be limited to:

· Your telephone number,
· Your e-mail address or other contact information,
· Any other Information that you provide during your registration process, if any, on the App
The Company provides for uploading photographs of the User/Subscriber when creating a profile. However, the User /Subscriber can opt out of providing for this data. By not uploading a profile picture of the User/Subscriber, the Company assures that such an act would not interfere with the usage of any products/features or services of the App by such User/Subscriber.
Company may also collect information other than Personal Information from User/Subscriber through the App when User/Subscriber visit and / or use the App. Such information may be stored in server logs. This information shall include, but not be limited to, the pages visited and time at which pages are visited on the App by the User/Subscriber.
2. MODE OF COLLECTION OF INFORMATION
2.1. When you use Melvano App, we collect and store your Information which is provided by you from time to time. Our primary goal in doing so is to provide you a safe, efficient, smooth and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize Melvano App to make your experience safer and easier. More importantly, while doing so we collect personal information from you that we consider necessary for achieving this purpose.
2.2. If you choose to use our services provided on the App, we may collect information about your behaviour pertaining to usage of services
2.3. If you send us personal correspondence, such as emails or letters, or if the other Users or third parties send us correspondence about your activities or postings on the App, we may collect such information into a file specific to you.
3. USE OF INFORMATION
3.1. The Company undertakes not to disclose (includes selling, sharing and renting) Information collected by the Company at any time to any third party without your consent. The Company reserves the right to store the information provided by the User/Subscriber indefinitely in the Company’s database. However, the Company also reserves the right to disclose Information in good faith:
· if required by law or any authority;
· to protect and defend rights and interests of the Company, employees / agents of the Company, other Users or the general public;
· to enforce Terms of Use and other policies of the Company;
· to address concerns raised by a third party.
3.2. The Company uses personal information to provide the services, improve the experience of the User/Subscriber. Scores of the User/ Subscriber shall be tracked as this information would improve and aid in progressing the performance of the User/Subscriber. Additionally, the Company may also use your personal information to market to you. We use your personal information to resolve disputes; troubleshoot problems; help promote a safe service; inform you about online and offline offers, products, services, and updates; customize your experience; detect and protect us against error, fraud and other criminal activity; enforce our terms and conditions; and as otherwise described to you at the time of collection.
3.3. The User/Subscriber, post registration on the App, shall not be able to withdraw consent to the Company to prevent using and processing the personal information provided by the User/Subscriber.
3.4. Certain features/products or services on the Melvano App may require for the User/Subscriber to grant the Company SMS reading or SD card permission. In the event, the User/Subscriber refuses to grant such permission to the Company, that particular feature/product or service shall be disabled for the User/Subscriber.
4. DATA CORRECTION
The User/Subscriber shall not have the right to edit or delete any personal information provided to the Company. However, this bar does not extend to editing/deleting the profile picture, if any, provided for by the User/Subscriber.
5. LINKS TO OTHER WEBSITES
The Melvano App may carry links to other websites. Your use of and activity at such other websites are at your own risk and the Company takes no responsibility regarding Information dissipated by you at such websites.
6.1. The Melvano App has industry standard security measures in place to protect the loss, misuse, and alteration of the information collected by the Company. All the information provided by the User/Subscriber is encrypted via Security Socket Layer (SSL). Additionally, we also have Dos (Denial Of Service) Attacks in place.
6.2. Although we will do our best to protect your personal information, we cannot guarantee the security of your data transmitted to our App and any transmission is at your own risk. Once we receive, your personal information we will use strict procedures and security features to try to prevent unauthorised access.
6.3. We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorised access, alteration, disclosure or destruction of your personal information
6.4. The Melvano App is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our App as safe as possible.
6.5. Your personal information is securely contained in our database and is only accessible by a limited number of persons who have special access rights to such systems are required to keep the information confidential.
6.6. All payment transactions are processed through secure gateway providers and are not stored or processed on our database
7. DISCLAIMER AS TO LOSS
Although, the Company has ensured the security of Personal Information collected. However, considering the open nature of Internet, such Information may be accessed by unauthorised entities/ software/ codes (“Hackers”). The Company assumes no liability whatsoever with respect to access of Information by Hackers.
8. SALE, MERGER OF THE COMPANY
Information collected by the Company is considered to be trade secret of the Company. As the owner of such trade secret, the Company has right to disclose or sell the Information as an asset of the Company during any sale or merger.
9. TESTIMONIALS
We post User/Subscriber testimonials on our App which may contain personal information. Prior to posting the testimonial, we obtain the User’s/Subscriber’s consent to post their name long with their testimonial. If User/Subscriber wants the testimonial removed, such User/Subscriber can reach out to the Company at [email protected].
By using the Melvano App and/ or by providing your information, you consent to the collection and use of the information you disclose on the Melvano App in accordance with this Privacy Policy, including but not limited to your consent for sharing your information as per this Privacy Policy.
11. CHANGES TO THIS POLICY
The Company reserves the right to amend this Policy, from time to time, as required or in pursuance to change in relevant laws.
If we decide to change our privacy policy, we will post those changes on this page so that you are always aware of what information we collect and how we use it. Any change to the Policy would be communicated to you via a push pop-up notification on the User’s/Subscriber’s application
12. GRIEVANCE AND QUERIES
In case of any grievance or queries, in respect of the Privacy Policy or the User’s/Subscriber’s dealing with the Company, the Company may be contacted via email at [email protected]
13. GOVERNING LAW AND JURISDICTION:
In the event of any dispute arising between the parties with respect to this Agreement, the same shall be referred to the Sole Arbitrator and the arbitration shall be in accordance with Arbitration and Conciliation Act of 1996. The language of arbitration proceeding shall be English. The seat and place of arbitration shall be Kanpur, Uttar Pradesh and the decision of the Arbitrator shall be final and binding on both parties herein.
This contract shall be subject to the exclusive jurisdiction of courts in Kanpur, Uttar Pradesh, India and shall be governed by the Indian laws.
